Any services presented on the websites of ABA are subject to these Terms of Use. 

Preamble 

Austrian Business Agency österreichische Industrieansiedlungs- und WirtschaftswerbungsgmbH (hereafter “ABA”) is a non-profit company under the auspices of the Republic of Austria whose objective is to promote Austria as a business, work and film location.  

The services provided by ABA are designed to support (foreign) companies and skilled workers by offering a comprehensive range of information. 

General provisions 

The services offered on the websites of ABA are subject to the present Terms of Use. By using our websites (in particular aba.gv.at, investinaustria.at, www.workinaustria.com, www.filminaustria.com, our online guides (e.g. Immigration Guide Austria) or online platforms (e.g. ABA Talent Hub), you agree to these Terms of Use as well as our disclaimer. 

ABA reserves the right to amend these Terms of Use from time to time. The current version is always available on our websites. Please access our Terms of Use at regular intervals to stay up to date on the latest version.  

Separate terms may apply to individual sections of content or services on the websites of ABA, in particular to services that require prior registration/login with special terms to be observed upon using them (e.g. ABA Talent Hub). 

Information

The content of our websites, online guides and online platforms, which are designed to provide you with basic information on various topics, has been compiled and prepared to the best of our knowledge and belief, and is updated on an ongoing basis. This information shall not to be construed as legal statements or binding advice – and shall not establish any kind of advisory relationship between you and ABA. The presentation of our content is guided by the needs of our users. We endeavour to provide any legal content clearly and comprehensibly. Nevertheless, only law stipulates what is legally binding. Any information you will find on our websites is non-binding in nature and intended for the purpose of general information and as a guide. Any information and content on our websites, however, cannot replace professional and specialised legal advice, as the assessment of an individual case requires specific facts and circumstances. 

ABA gives no guarantee for any information provided by using our websites, nor shall any legal claims or assurances be derived from this. Website users shall access and make use of the content of our websites, online guides and online platforms at their own risk. Any errors in content will, of course, be corrected as soon as we become aware of them (Have you found an error? Please report it here (hyperlink to the contact form). Nevertheless, we accept no liability and/or guarantee for the correctness, completeness, topicality, and accuracy of the information provided. Any claims to liability and/or compensation are excluded, in particular liability claims relating to direct or indirect damage, consequential damage, and/or any other disadvantages, whether material or immaterial, caused by the use or non-use of the information provided or by incorrect, incomplete, or outdated information.  

ABA reserves the right to make changes and/or additions to the information and content provided at any time without prior notice. In addition, ABA may – without prior notice – discontinue services or restrict them to certain user groups.  

Availability  

ABA strives to keep the services and information offered on its websites up to date and available at all times. However, our users shall not be entitled to benefit from the services of ABA. The use of websites, in particular, may be temporarily interrupted at any time due to maintenance work, updates or technical improvements, or due to the revision of content and/or its presentation. 

ABA does not guarantee the uninterrupted availability, reliability, functionality or accuracy of our services. We shall not be held liable for transmission failures or any delays caused by technical reasons. Moreover, we give no guarantee that the websites are free from computer viruses or other harmful components, or that content is safe or protected, and will not be lost or damaged.  

Although we use reasonable care and skill in the provision of our websites, we accept no further warranties with regard to our services. Any warranty and liability, in particular for damages resulting from the use of our websites and the information/services offered for download, are excluded. The same shall apply to claims for damages by a user or third party due to the use or non-availability of ABA services. 

Use

You may use the information and content provided on our websites exclusively for your own purposes, unless otherwise expressly permitted in writing by ABA. The distribution and forwarding of this information and content to third parties as well as its commercial use are excluded.  

Any website access in the following ways shall be prohibited. You shall not perform the following actions – neither in whole nor in part – under any circumstances: 

  1. Reproduce, modify, edit, publicly distribute, lend or store content, e.g. of texts, parts of texts, and image material of the website, in particular on end devices or media to which other persons or companies have access, including the implementation of this content on third-party websites and the inclusion of this content in electronic databases (any integration of individual pages in external frames shall be strictly prohibited); 

  2. copy or reproduce, translate, reverse engineer, derive source code, modify, disassemble, decompile, or create related works based on or in relation to the website; 

  3. change or falsify any information content within the website;  

  4. take any action that is likely to impair the smooth operation of the website (e.g. any function that may lead to a disproportionately high load on website infrastructure;  

  5. spread viruses, Trojans, and other harmful files on the website. 

We would like to specifically point out that any offence against the secure operation of the website may be prosecuted under civil and criminal law. 

Property rights / copyright and labelling rights 

  1. Any website content shall be subject to copyright and other intellectual property rights of ABA as well as corresponding licensors. ABA is the owner and/or licence holder of all rights, titles, and claims in connection with the websites, including in particular all virtual content that appears on the website (layout and individual elements, such as images, logos, videos, etc., whether or not they are integrated into documents, such as PDFs, or can be found separately on the website); all data and messages generated or created by the website; all accounts; all sounds and other sound effects as well as programming codes, work processes, software, associated documentation, and any other original work of ABA contained on the website. In consequence, these shall not be used commercially, printed, copied, modified or used in any other way. Any reproduction, processing, distribution or other use of ABA services shall only be permitted within the expressly authorised framework (e.g. for download if expressly offered). 

    ABA endeavours to observe the copyright of any graphics, sound documents, video sequences and texts used in publications, to make use of its own graphics, sound documents, video sequences and texts, or to use licence-free graphics, sound documents, video sequences and texts. 

Third-party content

The websites of ABA shall be construed as service and information platforms that also contain links to other online sites. These direct or indirect links to third-party websites are provided on our websites as references to further sources. However, ABA accepts no liability for the accuracy, completeness, legality, objectivity, and topicality of any linked websites, especially as we have no influence on the design and content of the linked websites. Only the providers of these websites may be held responsible for the content of linked pages. ABA does not adopt these contents as its own. In case of any illegal, incorrect, or incomplete content, in particular for damages resulting from the use or non-use of such information, only the provider of a referenced website may be held liable – and not ABA, which merely refers to the respective publication via links. This provision shall apply to any and all links on our website. 

If linked websites contain any illegal, erroneous, incomplete, offensive, or immoral information (in particular due to changes to the content after setting the hyperlink), and ABA becomes aware of this, the link will be removed immediately. If ABA refers to pages whose content gives cause for complaint, please notify us: office@aba.gv.at or hyperlink to the contact form). There was no apparent legal offence at the time of the initial ‘link’ to the external website in question. 

ABA does not continuously monitor external websites that can be accessed via hyperlinks or that refer to our website via hyperlinks. 

Cookies

ABA uses cookies to optimise our websites. ABA services may not be in whole or in part due to the cookie preferences selected by the user – this applies in particular if you use our websites without cookies. For further information please consult our Privacy Policy.

Contact

We look forward to hearing from you (contact form or send an e-mail to office@aba.gv.at). Please note that you may only contact us in your own name. ABA explicitly points out that any messages you send using our website will not be treated as confidential. The user is aware that only limited confidentiality is guaranteed for unencrypted e-mails. 

Miscellaneous 

Should individual provisions of these Terms of Use become invalid in whole or in part, they shall be replaced by a provision that comes closest to the economic purpose. All other provisions shall remain in full force and effect. 

The place of jurisdiction shall be the registered office of ABA in 1010 Vienna. In cases where this is not permissible, the statutory place of jurisdiction shall apply. Austrian law shall apply exclusively with the exclusion of the UN Convention on Contracts for the International Sale of Goods. The contractual language is German.
